Terms of Use

These terms are an agreement between you and Krikdex (Pty) Ltd ("Krikdex", "we"), Church Street, Graaff-Reinet, Eastern Cape, 6280, South Africa. By creating an account, by replying YES to an email from Rota, or by using Rota you accept them. If you do not accept them, do not use Rota.

1. What Rota is

Rota is a mobile app in which staff at South African hospitals share their departments' call rosters. A signed-in, verified user uploads a roster as a photo, PDF, Word or Excel file; other signed-in users open it. Rota is a notice board run by its users, not an official source of duty information and not part of any hospital's systems.

2. Who may use Rota

You must be 18 or older, work at or with a hospital or health facility, and have an email address you control. You may hold one account.

3. Your account

You sign in with your email address and a password; a one-time code sent to the address confirms that it is yours. Keep them to yourself; you are responsible for what is done with your account. Tell us at once if you believe someone else is using it. Your display name should be the name your colleagues know you by.

An account made by email. If you email a roster to rota.roster@gmail.com from an address that has no account, Rota asks you before doing anything with it. Replying YES accepts these terms and creates an account for that address, and the roster is then published under your name like any upload. From then on, rosters emailed from that address are published without asking again. The account has no password until you set one in the app with a code sent to the address. Replying STOP to any email from Rota deletes an account made this way, and Rota accepts nothing further from the address. Whoever can send email from your address can publish rosters as you: keep your mailbox as safe as you would a password.

4. Your content

Everything you upload or email in (files, department names, and the details attached to them) is your content. Emailing a roster to Rota is uploading it: you are the person publishing it, and section 5 applies to you, whoever first drew the roster up. You keep whatever rights you have in it, and you grant Krikdex a non-exclusive, royalty-free, worldwide licence to store, copy, display and distribute it through Rota, and to make it available to other users, for as long as it is in Rota. The licence ends when the content is deleted, except for copies in backups, which are deleted in the ordinary course.

5. What you promise about your content

By uploading you confirm that:

  • you are entitled to share it, including the personal information of the colleagues it names (a roster the department has already published on its notice board normally qualifies);
  • it contains no patient information of any kind;
  • it contains no personal (non-work) phone numbers, home addresses or other details that do not belong on a notice board;
  • it is a genuine roster for the hospital, department and month you chose, as far as you know accurate, and does not infringe anyone's rights.

The test is simple: if the department would not pin it up in the corridor, do not upload it.

6. Who can see your content

Any signed-in, verified Rota user can open any roster and see the department, month and the display name of the uploader. Rota is not a private channel between members of one department, and you should assume anything you upload may be seen by anyone at any hospital.

7. Automatic deletion

  • A roster is deleted 125 days after it was uploaded, file and all; a daily roster after 21 days.
  • A department keeps its newest three months; when a fourth is uploaded the oldest is retired automatically. The daily roster keeps its newest fourteen days. A roster that arrives by email and is older than everything the department already has is not published, so that it cannot push a newer one out.
  • A roster emailed in that is waiting for your answer is deleted after 14 days if no answer comes.
  • Uploading a roster for a department and month that already has one replaces the earlier file.

We may shorten these periods, delete content sooner, or change the limits at any time. Do not treat Rota as storage: keep your own copy of anything you need.

8. Moderation

Every upload, replacement, deletion and restoration is recorded with the account that made it. Hospital admins (section 9) and Krikdex may, without notice and at their sole discretion, delete any roster, restore a deleted one, block a user from a hospital, or lock a hospital's rosters so that only admins can change them. An account that makes more changes in a day than our limit allows is paused automatically; a pause lasts up to seven days and can be lifted by emailing us. We are not obliged to monitor content, but we act on reports and remove content that breaks these terms.

9. Hospital admins

A user who adds a hospital becomes its first admin. Others may request admin access in the app; Krikdex decides on requests and may add or remove admins at any time. Admins act for their colleagues: they may delete, restore, block and lock as described in section 8, and must use those powers only to keep the hospital's rosters accurate and appropriate. An admin who misuses them loses the role.

10. What you may not do

  • Upload content that breaks section 5, is unlawful, defamatory, harassing or obscene, or that you have no right to share.
  • Upload anything that is not a call roster, or is a roster for a hospital or department you have no connection with.
  • Impersonate anyone, or use a display name that misleads.
  • Interfere with the service: probe, scrape, overload, reverse-engineer, or attempt to bypass its access controls or limits.
  • Use Rota for any commercial purpose, or for any purpose other than sharing and reading call rosters.

11. Reporting

Report a roster or a user through Settings › Report a roster problem in the app, or by email to krikdex@gmail.com. Tell us the hospital, department and month. We aim to review reports promptly and to remove content that breaks these terms.

12. Intellectual property

Rota, its design, code, name and logo belong to Krikdex. These terms give you a personal, non-transferable, revocable licence to install and use the app on devices you control, for the purpose described in section 1. You may not copy, modify, distribute or sell any part of Rota.

13. Third-party services

Rota relies on Google Firebase for accounts, storage and server logic and on Resend for email, and is distributed through the Apple App Store and Google Play. Your use of those services is also subject to their terms. Word and Excel files open in apps installed on your device, under those apps' terms.

14. Availability and changes

We provide Rota free of charge and as it is. We may change, suspend or discontinue any part of it at any time, and may set or change limits (file size, file types, retention, number of rosters, changes per day) without notice. We do not guarantee that Rota will be available, error-free or suitable for any particular purpose.

15. Rosters are not authoritative

Rosters in Rota are uploaded by users. Krikdex does not check them and does not warrant that any roster is current, complete or correct. Duty arrangements are between you, your colleagues and your employer; when it matters, confirm with your department. Krikdex is not responsible for any consequence of relying on a roster in Rota.

16. Termination

You may delete your account at any time in Settings. We may suspend or terminate your account, or your access to any hospital, if you break these terms, if the law requires it, or if we discontinue Rota. Sections 4 (for content still in Rota), 12, 15, 17, 18, 19 and 21 survive termination.

17. Disclaimer of warranties

To the fullest extent the law allows, Rota is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement.

18. Limitation of liability

To the fullest extent the law allows, Krikdex, its directors and employees are not liable for any indirect, incidental, special or consequential loss, or for loss of data, income or goodwill, arising out of or in connection with Rota or its content, however caused. Our total liability for all claims in connection with Rota in any twelve-month period is limited to R1 000. Nothing in these terms limits liability that cannot be limited under South African law, including under the Consumer Protection Act 68 of 2008 where it applies.

19. Your responsibility to us

You are responsible for your content and your use of Rota. If a claim is made against Krikdex because content you uploaded broke section 5 or 10, or because of your misuse of Rota, you will compensate us for the resulting loss, including reasonable legal costs.

20. Privacy

Our Privacy Policy (krikdex-sa.com/rota-privacy.html) explains what personal information Rota processes and why. It forms part of these terms.

21. Governing law and disputes

These terms are governed by the law of the Republic of South Africa. Before starting any proceedings, contact us at krikdex@gmail.com and give us a reasonable chance to resolve the matter. The courts of South Africa have jurisdiction over any dispute that cannot be resolved that way.

22. Changes to these terms and contact

We may change these terms as Rota changes; the date at the top shows the latest version, and material changes will be pointed out in the app. Continuing to use Rota after a change means you accept it.
