AGREEMENT TO TERMS
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ('you') and KRIKDEX (Pty) Ltd (doing business as Krikdex) ('Krikdex', 'we', 'us', or 'our'), concerning your access to and use of the Fona mobile application as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the 'Services').
You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the 'Last updated' date of these Terms of Service, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Service to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Service by your continued use of the Services after the date such revised Terms of Service are posted.
The Services are intended for people who work in or with hospitals and healthcare facilities in South Africa. By using the Services, you represent and warrant that this describes you and that you are using the Services in the course of that work.
1. DESCRIPTION OF SERVICES
Fona is a mobile application that lets people working in South African hospitals:
- Search a shared directory of hospital extensions, direct lines, bleeper numbers and email addresses
- Dial a number, or start an email, with one tap
- Star the contacts they use often, so those follow their account to a new device
- Add, correct and delete directory entries for the hospitals they work in
- Create a directory for a hospital that does not yet have one, and administer it
Important: Fona is a phone directory. It does not provide medical advice, diagnosis or treatment recommendations, holds no patient information, and takes no part in clinical decisions. It is not an emergency service and cannot connect you to one.
Directory content is contributed and corrected by users, in the open editing model used by the hospital directory service that withdrew from South Africa in 2026. We do not verify directory content. Every change is attributed to the account that made it, so that errors and abuse can be traced, undone and stopped.
The Services require an internet connection to sign in, to receive new and changed contacts, and to save changes. Once a hospital directory has loaded, Fona keeps a copy on your device so you can search it without a connection.
2. ELIGIBILITY AND REGISTRATION
To use the Services, you must:
- Be at least 18 years of age
- Work in or with a hospital or healthcare facility in South Africa, in a clinical, allied health, pharmacy, administrative, switchboard or support role
- Be using the Services in the course of that work
- Have the legal capacity to enter into a binding agreement
We do not currently verify your employment, your professional registration or your work email address. Your eligibility is a representation you make to us, and we rely on it. Using the Services while knowing that you do not meet these requirements is a breach of these Terms.
By registering for an account, you represent and warrant that:
- All registration information you submit is truthful and accurate
- You will maintain the accuracy of such information
- Your use of the Services does not violate any applicable law, regulation, professional obligation or condition of your employment
- You have the authority to bind any entity on whose behalf you are using the Services
We reserve the right to refuse registration or terminate accounts if we have reason to believe that any of the above requirements are not met. We may in future require proof of employment or professional registration before granting editing rights.
3. USER ACCOUNTS
Account Creation: When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your account.
Email Verification: Only verified accounts may add, edit or delete directory content. If you register with an email address and password, you must confirm the six-digit code we email you. Accounts created with Google or Apple arrive verified. This check is the principal protection an openly editable directory has, and you may not attempt to circumvent it.
Account Security: You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
Account Credentials: Your login credentials are personal to you and may not be shared. Each person must have their own individual account, because every directory change is attributed to an account and a shared account destroys that accountability. Sharing accounts is strictly prohibited and may result in immediate termination.
One Account Per User: Each user may only maintain one active account. Creating multiple accounts, in particular to evade a block imposed by a hospital directory admin, may result in termination of all accounts.
4. DIRECTORY CONTENT AND YOUR RESPONSIBILITIES AS AN EDITOR
Fona's directories are open: any verified, non-blocked user may add, correct and delete entries in any hospital directory. This works only because everyone editing takes it seriously. By editing a directory you acknowledge and agree to the following.
Accuracy:
- Add contact details you have reason to believe are correct
- Correct an entry you find to be wrong, rather than adding a second entry beside it
- Delete entries for wards, roles, numbers and addresses that no longer exist
- Understand that you may be relied on by a colleague at three in the morning
What belongs in a directory: work contact details for wards, departments, roles, on-call rotas, switchboards and staff acting in their professional capacity, which is the kind of information a hospital publishes on its own internal directory sheet.
What must never be added:
- Patient names, patient numbers, clinical details or any other patient information
- A person's private mobile number or personal email address, unless that person has agreed to it being listed
- Special personal information as defined by POPIA, including health, race, religion, political affiliation, trade union membership, sexual orientation or criminal history
- False, misleading, offensive or abusive entries, or comments about a colleague
- Anything you are prohibited from disclosing by your employer, your regulator or your duty of confidentiality
Other people's information: when you add an entry naming a colleague you are processing their personal information, and POPIA applies to you when you do. Add only what belongs in a workplace directory, and remove it if they ask. Any person may ask us to remove an entry containing their personal information, and we will.
Attribution: every add, edit and deletion records your account identifier and the time. Your name is shown to other users against entries you created. You may not attempt to make a change appear to come from another account.
Licence you grant: by adding content to a directory you grant us and the other users of that directory a perpetual, irrevocable, worldwide, royalty-free licence to store, display, distribute and modify that content within the Services. This is necessary because a shared directory cannot function if a contribution can be withdrawn from it later. It does not apply to content that must be removed under POPIA or other law, which we will remove on request.
Content remains after you leave: contacts you contributed stay in their directories when you delete your account, but are no longer linked to your name or email address.
Moderation: we do not review directory content before it appears. We may remove content, and block or terminate accounts, where content breaches these Terms or the law.
5. HOSPITAL DIRECTORIES AND ADMINISTRATORS
Creating a directory: any verified user may create a directory for a hospital and becomes its first administrator. In doing so you represent that the hospital exists, that you have a genuine connection to it, and that the details you enter are accurate.
Administrator powers: an administrator of a hospital directory may add and remove other administrators, block users from editing that directory, restore deleted contacts, permanently remove contacts, and set the hospital's name, province, type, dialling prefix and switchboard number.
Administrator responsibilities: administrators must grant admin rights only to colleagues who need them, use blocking to prevent abuse rather than to win a disagreement, keep the dialling prefix and switchboard number correct, since every extension in that directory dials through them, and act on removal requests from people whose details appear in the directory.
Our powers: we may add or remove administrators, remove or restore content, transfer administration of a directory, and suspend or delete a hospital directory, where we reasonably believe it is necessary to keep the Services accurate, lawful or safe. A directory is not owned by the user who created it.
Not an official record: a hospital directory in Fona is created and maintained by users. It is not an official publication of, and is not endorsed or verified by, the hospital, its management, any provincial Department of Health, or the National Department of Health, unless expressly stated.
6. PRICE AND PAID FEATURES
Fona is currently free. There is no subscription, no in-app purchase and no advertising, and we do not collect payment or banking details.
We reserve the right to introduce paid features, subscription tiers or pricing in future. If we do:
- We will give at least 30 days' notice by in-app notification, by email to registered users, or both
- We will make clear which features are affected and which remain free
- You may continue using any features that remain free, or stop using the Services, rather than pay
- Any payment would be processed through the Apple App Store or Google Play, subject to their terms, and any refund would be handled under their refund policies
- We would not receive or store your card details
7. INTELLECTUAL PROPERTY RIGHTS
Our Intellectual Property: the Services and all content, features, and functionality (including the software, text, displays, images, graphics, and the design, selection, and arrangement thereof, and the Fona name and logo) are owned by KRIKDEX (Pty) Ltd, its licensors, or other providers of such material and are protected by South African and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Licence to Use: subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to:
- Download and install the app on a mobile device you own or control
- Use the Services in the course of your work in or with a South African healthcare facility
- Look up and use individual contact details from the directory for the purpose of contacting that ward, department or person about your work
Restrictions: you may not:
- Copy, modify, or create derivative works of the Services
- Reverse engineer, decompile, or disassemble the Services
- Remove any copyright or proprietary notices from the Services
- Transfer, sublicense, or assign your rights under these Terms
- Extract, scrape or export directory content in bulk, by automated means or otherwise
- Use the Services or their content to build a competing product or service, or to compile a database
Directory Content: contributions to a directory are licensed to us and to other users as set out in section 4. The compilation of the directories, meaning their selection, arrangement and structure, is our intellectual property, and bulk extraction of it is prohibited whether or not the individual entries are themselves protected.
8. USER REPRESENTATIONS
By using the Services, you represent and warrant that:
- You work in or with a hospital or healthcare facility in South Africa and are using the Services in the course of that work

- You will not access the Services through automated or non-human means
- You will not use the Services to harass, abuse, or harm another person
- You have the right to add any contact details you contribute to a directory
9. PROHIBITED ACTIVITIES
You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree NOT to:
- Add patient information, or any other confidential clinical information, to a directory
- Add a person's private contact details without their agreement
- Add false, misleading, offensive or abusive entries, or vandalise a directory
- Delete accurate entries other than to correct or replace them
- Extract, scrape, copy, export or systematically download directory content in bulk
- Use directory content for marketing, sales, recruitment, fundraising, political campaigning, or any other unsolicited contact with hospital staff
- Sell, licence, publish or otherwise redistribute directory content
- Use the Services to send unsolicited communications of any kind
- Share your account credentials, use another person's account, or create an account to evade a block
- Attempt to make a directory change appear to come from another account
- Impersonate a hospital, a department, an official body, or another person
- Use any robot, spider, or other automatic device to access the Services
- Introduce viruses, trojan horses, worms, or other malicious code
- Attempt to gain unauthorised access to any portion of the Services, or to another user's data
- Circumvent, disable, or otherwise interfere with security-related features, including email verification
- Interfere with the proper working of the Services, or use them in a manner that could disable, overburden, damage or impair them
- Decipher, decompile, disassemble, or reverse engineer any of the software
- Delete any copyright or other proprietary rights notice from any content
- Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services
- Use the Services in a manner inconsistent with any applicable laws or regulations
- Sell or otherwise transfer your account
10. DATA AND PRIVACY
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information when you use the Services.
No patient data: Fona holds no patient information. There is no patient record in the app and nowhere to create one. You must not enter patient information anywhere in the Services.
What we store on our servers:
- Your account: email address and sign-in credentials, first and last name, and optionally your profession and default hospital
- Your favourites, so they follow your account to a new device
- All directory content, together with a record of which account created, edited or deleted each entry and when
- Hashed one-time verification codes, which delete themselves automatically within an hour
What stays on your device:
- Your recents, the list of contacts you have recently called or emailed, which is never uploaded
- A cached copy of each directory you have opened, so search works offline
Usage counts: the app counts installs, active users and the screens that get used, through Google Analytics for Firebase and RevenueCat. Neither receives your name, your email address, what you search for, or the contacts you open or dial. The Privacy Policy sets out exactly what each one receives.
What we do not collect: your location, your phone's contact list, a record of the calls or emails you make, your advertising identifier, or payment details. The app includes no advertising or crash-reporting SDK.
Visibility to other users: directory entries you contribute, and your name against them, are visible to all signed-in users of that directory. Your email address, favourites, profession and default hospital are not.
Data Security: we implement appropriate technical and organisational measures to protect data processed through our Services. However, no method of transmission over the Internet or electronic storage is 100% secure.
POPIA: both we and you have obligations under the Protection of Personal Information Act in respect of the contact details held in the directories. Ours are set out in the Privacy Policy; yours are set out in section 4 of these Terms.
11. THIRD-PARTY SERVICES
The Services depend on and integrate with third-party services that we do not own or control.
Google Firebase: we use Google Firebase for user authentication, database storage, cloud functions and hosting. Your use of the Services necessarily involves Google processing your data, subject to Google's terms and privacy policy. Firebase infrastructure is located outside South Africa, primarily in the United States.
Google Analytics for Firebase: we use Google Analytics to count installs, active users and screen views. It identifies an installation of the app, not you or your account.
RevenueCat: we use RevenueCat to count new and active accounts. It receives your internal account identifier and no name, email address or payment detail. Fona has nothing to buy, and no purchase is made through it.
Resend: we use Resend to deliver verification and password-reset emails.
Google and Apple sign-in: if you choose to sign in with Google or Apple, your use of those sign-in services is subject to their respective terms.
Your phone's dialler and mail app: tapping a number or address hands it to your device's own dialler or mail application. Fona does not place calls or send email, and your network operator's charges and terms apply to the call.
App Stores: the Services are distributed through the Apple App Store and Google Play. Your use of these platforms is subject to their respective terms of service.
We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any such third-party services.
12. SERVICES MANAGEMENT
We reserve the right, but not the obligation, to:
- Monitor the Services for violations of these Terms
- Take appropriate legal action against anyone who violates these Terms
- Refuse, restrict access to, limit the availability of, or disable any user's account
- Remove, edit or restore any directory content, and suspend or delete any hospital directory
- Add or remove administrators of a hospital directory
- Remove or disable content that is excessive in size or burdensome to our systems
- Manage the Services in a manner designed to protect our rights and property
- Terminate accounts that we determine, in our sole discretion, to be in violation of these Terms
13. TERM AND TERMINATION

Termination by You: you may terminate your account at any time by:
- Deleting your account in the app under Settings, then Delete my account
- Contacting us at krikdex@gmail.com
- Uninstalling the application, which does not by itself delete your account
Termination by Us: we may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Effect of Termination: upon termination:
- Your right to use the Services will immediately cease, and you must cease all use of them
- Your profile, your email record and your favourites are deleted from our servers
- You are removed from the administrator and blocked lists of every hospital directory
- Directory entries you contributed remain in their directories, no longer linked to your name or email address, under the licence granted in section 4
- Your recents and cached directories remain on your device until you uninstall the app
Survival: the following provisions shall survive termination: the licence granted in section 4, Intellectual Property Rights, Disclaimers, Limitations of Liability, Indemnification, Governing Law, Dispute Resolution, and any other provisions that by their nature should survive.
14. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Services without notice at any time.
We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.
We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time or for any reason without notice to you.
You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance of the Services. Do not depend on the Services for time-critical contact; see section 17.
15. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the Eastern Cape Province, South Africa, and you hereby consent to the personal jurisdiction and venue therein.
16. DISPUTE RESOLUTION
Informal Negotiations: to expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms ('Dispute'), you and we agree to first attempt to negotiate any Dispute informally for at least 30 days before initiating arbitration. Such informal negotiations commence upon written notice from one party to the other.
Binding Arbitration: if we cannot resolve a Dispute through informal negotiations, either party may elect to have the Dispute finally and exclusively resolved by binding arbitration. The arbitration shall be conducted in accordance with the Arbitration Act 42 of 1965 of South Africa.
Restrictions: you agree that any arbitration shall be limited to the Dispute between you and us individually. You agree that:
- No arbitration shall be joined with any other proceeding
- There is no right or authority for any Dispute to be arbitrated on a class-action basis
- There is no right or authority for any Dispute to be brought in a purported representative capacity
Exceptions: the parties agree that the following Disputes are not subject to arbitration:
- Any Disputes seeking to enforce or protect intellectual property rights
- Any Dispute related to actual or threatened infringement
- Any request for injunctive relief
Nothing in this section limits your right to lodge a complaint with the Information Regulator (South Africa) about the processing of your personal information.
17. DISCLAIMERS

DIRECTORY ACCURACY: DIRECTORY CONTENT IS CONTRIBUTED, EDITED AND DELETED BY USERS. WE DO NOT VERIFY IT. YOU ARE RESPONSIBLE FOR VERIFYING ANY CONTACT DETAIL BEFORE RELYING ON IT.
NOT AN EMERGENCY SERVICE: FONA IS NOT AN EMERGENCY SERVICE AND CANNOT CONNECT YOU TO ONE. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE GREATER OF THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING, OR ONE THOUSAND RAND (R1,000).
CLINICAL AND OPERATIONAL OUTCOMES: WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM AN INCORRECT, OUT-OF-DATE OR MISSING DIRECTORY ENTRY, FROM A CALL THAT REACHED THE WRONG PERSON OR NOBODY AT ALL, OR FROM ANY DELAY IN CONTACTING A COLLEAGUE, DEPARTMENT OR SERVICE, INCLUDING WHERE THAT DELAY CONTRIBUTES TO PATIENT HARM.
CERTAIN SOUTH AFRICAN LAWS, INCLUDING THE CONSUMER PROTECTION ACT 68 OF 2008, DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS. NOTHING IN THESE TERMS EXCLUDES LIABILITY FOR GROSS NEGLIGENCE OR WILFUL MISCONDUCT WHERE SUCH EXCLUSION IS PROHIBITED BY LAW.
19. INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of:

- Your use of directory content for any purpose prohibited by section 9
Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defence of such claims.

21. MISCELLANEOUS
Entire Agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Services.
Waiver: our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
Severability: if any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
Assignment: we may assign our rights and obligations under these Terms without restriction. You may not assign your rights or obligations under these Terms without our prior written consent.
