IMPORTANT

PracticeOne is a legal practice management and trust accounting tool designed for South African attorneys and law practices. Your privacy — and the privacy of your clients' information — is important to us. All practice, client, matter, and trust accounting data you enter into PracticeOne is stored in our secure cloud infrastructure (Google Firebase) and is accessible only to you and the team members of your practice. Your login credentials are secured using industry-standard encryption. Your practice records remain under your control at all times.

We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We process your information only when we have a valid legal reason to do so.

In what situations and with which parties do we share personal information?

We may share information in specific situations and with specific third parties for authentication and data storage purposes only.

How do we keep your information safe?

We have implemented platform-level encryption, secure authentication, and industry-standard security practices through Google Firebase. All data is transmitted over encrypted connections and stored securely in our cloud infrastructure.

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us for account creation and service delivery.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

  • Email address
  • Name (for account purposes)
  • Password (encrypted)

Practice and Client Data (Stored in Our Secure Cloud):

  • Practice name and details (registration numbers, VAT information, contact details, address, and banking details for the trust and business accounts)
  • Client records (names, company names, contact persons, phone numbers, email addresses, and file numbers)
  • Matter records (parties, matter type, status, assignment, and trust balance)
  • Trust accounting records (receipts, payments, transfers, business payments, references, and descriptions)
  • Team membership and role assignments
  • Practice logo (if uploaded)

Team Member Information:

  • Names and email addresses of practice members
  • Role assignments within the practice (Managing Director, Director, Attorney, Candidate Attorney, Bookkeeper, Support Staff)

Sensitive Information. PracticeOne stores all practice, client, matter, and trust accounting data in our secure cloud infrastructure (Google Firebase). This data is accessible only to the members of the practice it belongs to. We do not sell, share, or use this data for any purpose other than providing the Services. Client information entered into the app may be subject to professional confidentiality obligations; responsibility for complying with those obligations remains with the practice.

Application Data. If you use our application(s), we also may collect the following information:

  • Device Data. We automatically collect device information (such as your device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model, Internet service provider and/or mobile carrier, and Internet Protocol (IP) address (or proxy server).

This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you use our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

The information we collect includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files.
  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.
  • To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service, including storing and managing your practice, client, matter, and trust accounting data.
  • To enable team collaboration. We process names, email addresses, and role information to facilitate practice membership, invite codes, and the management of team members within your practice.
  • To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
  • To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and conditions, and other similar information.
  • To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
  • To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention.
  • To evaluate and improve our Services, products, marketing, and your experience. We may process your information when we believe it is necessary to identify usage trends, determine the effectiveness of our promotional campaigns, and to evaluate and improve our Services, products, marketing, and your experience.

3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

We may need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Service Providers. We use Google Firebase for user authentication, data storage, and app infrastructure. Firebase processes:
  • Your email address and authentication credentials (encrypted)
  • All practice, client, matter, and trust accounting data you enter into the app
  • App analytics and crash reports
  • Legal Requirements. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process.

What We Do NOT Share:

  • Your practice, client, or trust accounting records with any third parties
  • Your personal or team member information for marketing purposes
  • Any of your data with advertisers

Documents You Generate: PracticeOne lets you generate PDF statements, ledgers, and trust account reports and share them (for example by email or printing). Once you export or share a document, its distribution is under your control and your responsibility.

4. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfil the purposes outlined in this privacy notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

  • Account Information: Retained for as long as your account is active, plus 90 days after account deletion request.
  • Practice, Client, Matter, and Trust Accounting Data: Retained for as long as the practice is active. Note that trust accounting records may be subject to statutory retention periods under South African law; maintaining compliant copies of those records is the responsibility of the practice.
  • Analytics Data: Retained for up to 26 months.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

5. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organisational and technical security measures.

We have implemented appropriate and reasonable technical and organisational security measures designed to protect the security of any personal information we process. These include:

  • Firebase Security Rules: All data stored in Google Firebase is protected by security rules that restrict access to authenticated users who are members of the relevant practice only.
  • Encrypted Transmission: All data transmitted between the app and our cloud infrastructure uses industry-standard TLS encryption.
  • Authentication Security: Password requirements enforce strong passwords. Email verification via a one-time code is required during registration.
  • Role-Based Access Control: Practice data is only accessible to the members of the practice, and sensitive operations (such as managing members and invites) are restricted to the Managing Director and Directors.
  • Server-Side Enforcement: Practice membership changes and trust accounting integrity constraints (such as the rule that a matter's trust balance may never be overdrawn) are enforced server-side.
  • Platform-Level Security: We rely on Google Firebase's industry-leading security infrastructure, including regular security audits and compliance certifications.

However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorised third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

6. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 7. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your account at any time.

Account Information: If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Log in to your account settings and update your user account
  • Contact us using the contact information provided

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section 'HOW CAN YOU CONTACT US ABOUT THIS NOTICE?' below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal, nor when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

8. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ('DNT') feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

9. PROTECTION OF PERSONAL INFORMATION ACT (POPIA) COMPLIANCE

In Short: We are committed to complying with South Africa's Protection of Personal Information Act.

PracticeOne is designed with privacy-by-design principles in alignment with the Protection of Personal Information Act (POPIA) of South Africa. As a user of our Services, you have the following rights under POPIA:

  • Right to Access: You have the right to request access to the personal information we hold about you.
  • Right to Correction: You have the right to request correction of inaccurate personal information.
  • Right to Deletion: You have the right to request deletion of your personal information, subject to legal retention requirements.
  • Right to Object: You have the right to object to the processing of your personal information.
  • Right to Data Portability: You have the right to request a copy of your personal information in a commonly used format.

Your Clients' Personal Information: When you enter your clients' personal information into PracticeOne, your practice remains the responsible party under POPIA in respect of that information, and we process it solely on your behalf to provide the Services. Your practice is responsible for ensuring it has a lawful basis for processing its clients' personal information.

10. DO WE MAKE UPDATES TO THIS NOTICE?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

We may update this privacy notice from time to time. The updated version will be indicated by an updated 'Revised' date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.

11. SUBSCRIPTION AND PRICING

In Short: We reserve the right to introduce, modify, or discontinue subscription plans and pricing at any time.

Current Pricing: PracticeOne may offer free and/or paid subscription tiers. Current pricing is displayed within the application and on our official website.

Price Changes: We reserve the right to change subscription prices at any time, including but not limited to:

  • Introducing new subscription tiers
  • Modifying existing subscription prices (increases or decreases)
  • Changing the features included in each subscription tier
  • Converting free features to paid features
  • Discontinuing subscription plans

Notice of Price Changes: We will provide reasonable notice of any price increases through one or more of the following methods:

  • In-app notification at least 30 days before the change takes effect
  • Email notification to registered users
  • Notice posted in the application

Existing Subscriptions: For existing subscribers:

  • Price changes will take effect at the start of your next billing cycle following the notice period
  • You may cancel your subscription before the price change takes effect
  • Continued use of the Services after a price change constitutes acceptance of the new pricing

Refunds: Subscription fees are generally non-refundable except where required by applicable law or as explicitly stated in our refund policy.

Free Trial: If we offer a free trial period, we reserve the right to modify or discontinue free trials at any time. After the free trial period expires, you will be charged the applicable subscription fee unless you cancel before the trial ends.

By using our Services, you acknowledge and agree that subscription prices may change and that continued use after price changes constitutes acceptance of the new pricing terms.

14. DISCLAIMERS AND LIMITATION OF LIABILITY

In Short: You use our Services entirely at your own risk, and we cannot be held liable for practice management decisions or data accuracy.

You acknowledge that you use PracticeOne entirely at your own risk. While every effort is made to ensure the functionality and accuracy of our app, we cannot guarantee error-free operation.

Professional Responsibility: PracticeOne is a tool to assist attorneys and law practices in recording and managing practice, client, matter, and trust accounting data. All legal, accounting, and business decisions remain the sole responsibility of the user. We do not provide legal, accounting, financial, or business advice and are not responsible for:

  • Legal or business decisions made based on data recorded in the app
  • Errors in client, matter, or trust accounting records
  • Compliance with the Legal Practice Act, Legal Practice Council rules, or any other statutory or professional obligations
  • Loss of fees, funds, or revenue
  • Consequences arising from data inaccuracies

Third-Party Services: Our app uses third-party services (such as Firebase) for authentication and data storage. We are not responsible for any interruptions, errors, or issues caused by third-party services.

Limitation of Liability: To the maximum extent permitted by applicable law, KRIKDEX (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Services.

15. USER CONDUCT AND INDEMNIFICATION

In Short: You agree to use our Services lawfully and to indemnify us against claims arising from your use.

Acceptable Use: You agree that your use of PracticeOne is for lawful purposes only and in accordance with:

  • South African law
  • Applicable professional rules and regulations, including the rules of the Legal Practice Council
  • The terms and conditions of this privacy notice

Prohibited Activities: You may not:

  • Use the Services for any unlawful purpose
  • Enter false or misleading client, matter, or trust accounting data
  • Share your account credentials with unauthorised persons
  • Attempt to access data belonging to other users or practices
  • Interfere with the proper functioning of the Services
  • Use the Services in any manner that could disable, overburden, or impair the Services

Indemnification: You agree to indemnify and hold KRIKDEX (Pty) Ltd, its subsidiaries, affiliates, agents, officers, employees, and content providers harmless from any claim, demand, or damage, including reasonable attorneys' fees, arising from:

  • Your use of PracticeOne
  • Your violation of this privacy notice
  • Your violation of any rights of a third party
  • Any legal, accounting, or business decisions made using the Services
